Terms of Service

1. Who these terms apply to

These terms apply between you (or the organisation you represent, the "customer") and Andriescu IT, Chamber of Commerce (KvK) 71354263, VAT NL002218135B40, located at Ocarinalaan 138, 2287 RD, Rijswijk ZH, Nederland ("we", "RechterHand"), for the use of the RechterHand service.

2. The service

RechterHand is an AI assistant with related tools (email, calendar, documents, connections to external services). We do our best to provide a reliable service, but do not guarantee uninterrupted availability. Maintenance or outages can occur.

3. Your account

You are responsible for keeping your login details secret and for everything that happens under your account. If you notice unauthorised use, report it to us immediately.

4. Subscription and payment

  • The subscription is a recurring (monthly) payment, processed by our payment partner Mollie.
  • The current price is shown in your account. If we change the price, we will tell you at least 30 days in advance.
  • If a payment fails or is not made, we may suspend access to the service.
  • You can cancel at any time; the subscription then continues until the end of the current period.

5. Acceptable use

You do not use the service for:

  • Illegal activities or content;
  • Getting around security, or attempts to access other customers' data;
  • Overloading the service (for example automated abuse of the AI features).

If you break these rules, we may suspend or close your account.

6. Your data stays yours

Content you create, upload or generate through the assistant remains your property. We do not use your data for any purpose other than providing the service to you. See our privacy policy for details.

We only work with AI models whose terms exclude using your messages to train their general models (currently the paid Google Gemini API and DeepInfra), and we enforce this technically where possible (see section 4 of our privacy policy). Data received from Google APIs, such as your Google Calendar, is never used to train or improve any AI model.

7. AI-generated content

The assistant can make mistakes or give incorrect information ("hallucinate"). Check important AI output yourself, especially for financial, legal or medical decisions. We are not liable for decisions you base on AI output without checking it yourself.

8. Liability

Our liability is limited to the amount you paid in the last 12 months, except in case of intent or gross negligence. We are not liable for indirect or consequential damage, to the extent permitted by law.

9. Cancellation and termination

You can cancel at any time in your account settings. We may close your account for serious or repeated breach of these terms, or for long-term non-payment.

10. Changes to these terms

We may change these terms. We will inform you in advance of any significant change.

11. Applicable law

These terms are governed by Dutch law.

Algemene Voorwaarden

1. Voor wie deze voorwaarden gelden

Deze voorwaarden gelden tussen jou (of de organisatie die je vertegenwoordigt, "klant") en Andriescu IT, KvK 71354263, BTW NL002218135B40, gevestigd op Ocarinalaan 138, 2287 RD, Rijswijk ZH, Nederland ("wij", "RechterHand"), voor het gebruik van de RechterHand-dienst.

2. De dienst

RechterHand is een AI-assistent met bijbehorende tools (e-mail, agenda, documenten, koppelingen met externe diensten). We spannen ons in voor een betrouwbare dienst, maar garanderen geen ononderbroken beschikbaarheid. Onderhoud of storingen kunnen voorkomen.

3. Je account

Je bent zelf verantwoordelijk voor het geheimhouden van je inloggegevens en voor alles wat onder jouw account gebeurt. Zie je ongeautoriseerd gebruik? Meld dit direct bij ons.

4. Abonnement en betaling

  • Het abonnement is een terugkerende betaling (per maand), verwerkt via onze betaalpartner Mollie.
  • De actuele prijs staat in je account. Wijzigen we de prijs, dan laten we dit minimaal 30 dagen van tevoren weten.
  • Bij een mislukte of uitblijvende betaling kunnen we de toegang tot de dienst opschorten.
  • Je kunt op elk moment opzeggen; het abonnement loopt dan door tot het einde van de lopende periode.

5. Toegestaan gebruik

Je gebruikt de dienst niet voor:

  • Illegale activiteiten of content;
  • Het omzeilen van beveiliging, of pogingen tot toegang tot gegevens van andere klanten;
  • Overbelasting van de dienst (bijvoorbeeld geautomatiseerd misbruik van de AI-functies).

Bij overtreding kunnen we je account opschorten of beëindigen.

6. Jouw gegevens blijven van jou

Content die je aanmaakt, uploadt of via de assistent genereert, blijft jouw eigendom. Wij gebruiken je gegevens niet voor andere doeleinden dan het leveren van de dienst aan jou. Zie onze privacyverklaring voor de details.

We werken uitsluitend met AI-modellen waarvan de voorwaarden uitsluiten dat jouw berichten worden gebruikt om hun algemene modellen te trainen (op dit moment de betaalde Google Gemini API en DeepInfra), en dwingen dit technisch af waar mogelijk (zie sectie 4 van onze privacyverklaring). Gegevens uit Google API's, zoals je Google-agenda, worden nooit gebruikt om een AI-model te trainen of te verbeteren.

7. AI-gegenereerde inhoud

De assistent kan fouten maken of onjuiste informatie geven ("hallucineren"). Controleer belangrijke AI-output zelf, zeker bij financiële, juridische of medische beslissingen. Wij zijn niet aansprakelijk voor beslissingen die je zonder eigen controle op AI-output baseert.

8. Aansprakelijkheid

Onze aansprakelijkheid is beperkt tot het bedrag dat je in de laatste 12 maanden hebt betaald, behalve bij opzet of grove nalatigheid. We zijn niet aansprakelijk voor indirecte schade of gevolgschade, voor zover wettelijk toegestaan.

9. Opzegging en beëindiging

Jij kunt op elk moment opzeggen via je accountinstellingen. Wij kunnen je account beëindigen bij ernstige of herhaalde schending van deze voorwaarden, of bij langdurig uitblijven van betaling.

10. Wijzigingen in deze voorwaarden

We kunnen deze voorwaarden aanpassen. Bij een wezenlijke wijziging informeren we je vooraf.

11. Toepasselijk recht

Op deze voorwaarden is Nederlands recht van toepassing.

1. A quién se aplican estas condiciones

Estas condiciones se aplican entre tú (o la organización que representas, el "cliente") y Andriescu IT, Cámara de Comercio neerlandesa (KvK) 71354263, IVA NL002218135B40, con domicilio en Ocarinalaan 138, 2287 RD, Rijswijk ZH, Nederland ("nosotros", "RechterHand"), para el uso del servicio RechterHand.

2. El servicio

RechterHand es un asistente de IA con herramientas asociadas (correo, calendario, documentos, conexiones con servicios externos). Nos esforzamos por ofrecer un servicio fiable, pero no garantizamos una disponibilidad ininterrumpida. Pueden producirse mantenimientos o incidencias.

3. Tu cuenta

Eres responsable de mantener en secreto tus datos de acceso y de todo lo que ocurra con tu cuenta. Si detectas un uso no autorizado, avísanos de inmediato.

4. Suscripción y pago

  • La suscripción es un pago recurrente (mensual), procesado por nuestro socio de pagos Mollie.
  • El precio vigente aparece en tu cuenta. Si cambiamos el precio, te avisaremos con al menos 30 días de antelación.
  • Si un pago falla o no se realiza, podemos suspender el acceso al servicio.
  • Puedes darte de baja en cualquier momento; la suscripción continúa hasta el final del periodo en curso.

5. Uso permitido

No usas el servicio para:

  • Actividades o contenidos ilegales;
  • Eludir la seguridad o intentar acceder a datos de otros clientes;
  • Sobrecargar el servicio (por ejemplo, abuso automatizado de las funciones de IA).

En caso de infracción podemos suspender o cerrar tu cuenta.

6. Tus datos siguen siendo tuyos

El contenido que creas, subes o generas con el asistente sigue siendo de tu propiedad. No usamos tus datos para ningún fin distinto de prestarte el servicio. Consulta nuestra política de privacidad para más detalles.

Solo trabajamos con modelos de IA cuyas condiciones excluyen el uso de tus mensajes para entrenar sus modelos generales (actualmente la API de pago de Google Gemini y DeepInfra), y lo imponemos técnicamente cuando es posible (ver la sección 4 de nuestra política de privacidad). Los datos obtenidos de las API de Google, como tu Google Calendar, nunca se usan para entrenar o mejorar ningún modelo de IA.

7. Contenido generado por IA

El asistente puede cometer errores o dar información incorrecta ("alucinar"). Comprueba tú mismo los resultados importantes, sobre todo en decisiones financieras, jurídicas o médicas. No somos responsables de decisiones que tomes basándote en resultados de la IA sin comprobarlos.

8. Responsabilidad

Nuestra responsabilidad se limita al importe que hayas pagado en los últimos 12 meses, salvo en caso de dolo o negligencia grave. No somos responsables de daños indirectos o consecuentes, en la medida en que la ley lo permita.

9. Baja y rescisión

Puedes darte de baja en cualquier momento desde la configuración de tu cuenta. Podemos cerrar tu cuenta en caso de incumplimiento grave o reiterado de estas condiciones, o de impago prolongado.

10. Cambios en estas condiciones

Podemos modificar estas condiciones. Te informaremos con antelación de cualquier cambio importante.

11. Ley aplicable

Estas condiciones se rigen por la legislación neerlandesa.

1. Cui se aplică acești termeni

Acești termeni se aplică între tine (sau organizația pe care o reprezinți, "clientul") și Andriescu IT, Camera de Comerț olandeză (KvK) 71354263, TVA NL002218135B40, cu sediul la Ocarinalaan 138, 2287 RD, Rijswijk ZH, Nederland ("noi", "RechterHand"), pentru utilizarea serviciului RechterHand.

2. Serviciul

RechterHand este un asistent AI cu instrumente asociate (e-mail, calendar, documente, conexiuni cu servicii externe). Ne străduim să oferim un serviciu fiabil, dar nu garantăm disponibilitate neîntreruptă. Pot apărea lucrări de întreținere sau întreruperi.

3. Contul tău

Ești responsabil să păstrezi secrete datele de autentificare și pentru tot ce se întâmplă în contul tău. Dacă observi o utilizare neautorizată, anunță-ne imediat.

4. Abonament și plată

  • Abonamentul este o plată recurentă (lunară), procesată de partenerul nostru de plăți Mollie.
  • Prețul actual apare în contul tău. Dacă schimbăm prețul, te anunțăm cu cel puțin 30 de zile înainte.
  • Dacă o plată eșuează sau nu este efectuată, putem suspenda accesul la serviciu.
  • Poți anula oricând; abonamentul continuă apoi până la sfârșitul perioadei în curs.

5. Utilizare permisă

Nu folosești serviciul pentru:

  • Activități sau conținut ilegal;
  • Ocolirea securității sau încercări de a accesa datele altor clienți;
  • Supraîncărcarea serviciului (de exemplu abuz automatizat al funcțiilor AI).

În caz de încălcare putem suspenda sau închide contul tău.

6. Datele tale rămân ale tale

Conținutul pe care îl creezi, îl încarci sau îl generezi cu asistentul rămâne proprietatea ta. Nu folosim datele tale în alt scop decât furnizarea serviciului către tine. Vezi politica de confidențialitate pentru detalii.

Lucrăm doar cu modele AI ai căror termeni exclud folosirea mesajelor tale pentru antrenarea modelelor lor generale (în prezent Google Gemini API plătit și DeepInfra) și impunem acest lucru tehnic acolo unde este posibil (vezi secțiunea 4 din politica de confidențialitate). Datele primite prin API-urile Google, cum ar fi Google Calendar, nu sunt folosite niciodată pentru a antrena sau îmbunătăți vreun model AI.

7. Conținut generat de AI

Asistentul poate greși sau poate da informații incorecte ("halucinații"). Verifică singur rezultatele importante, mai ales pentru decizii financiare, juridice sau medicale. Nu răspundem pentru decizii bazate pe rezultate AI pe care nu le-ai verificat.

8. Răspundere

Răspunderea noastră este limitată la suma plătită de tine în ultimele 12 luni, cu excepția intenției sau a neglijenței grave. Nu răspundem pentru daune indirecte sau consecutive, în măsura permisă de lege.

9. Anulare și încetare

Poți anula oricând din setările contului. Putem închide contul tău în caz de încălcare gravă sau repetată a acestor termeni ori de neplată îndelungată.

10. Modificarea acestor termeni

Putem modifica acești termeni. Te vom informa în prealabil despre orice modificare importantă.

11. Legea aplicabilă

Acești termeni sunt guvernați de legea olandeză.
